Book Description
This book is the result of a work carried out in 2003 within the framework of the DEA of environmental law of the Universities of Paris 1 and 2. The "Charter of the environment of 2003" was then only '' a bill tabled in the National Assembly. It has since been incorporated into the French Constitution (1 March 2005) and applied by all jurisdictions. Awarded by the GRIDAUH, this work is cited several times in the report of the Commission of the Laws of the National Assembly on the Charter. The book remains relevant insofar as the text of the Charter has hardly been amended in Parliament. It brings together the main "keys" useful for the interpretation of the text: history of the constitutionalisation process, intention of the authors, editorial decisions etc. It thus makes it possible to take a step back from the "oriented" interpretations that have subsequently developed, notably in Parliament. Finally, the developments concerning the potential scope of the Charter have not been contradicted by the subsequent case law (see the three chronicles co-authored by the author and published in the 2007 Legal Review of the Environment). and 2010).
