If cross-border legal violations occur in companies, the question arises as to which of the affected states is responsible for the prosecution and sanctioning of the association and whether there is a risk of multiple punishments by different legal systems. The resulting problem of positive conflicts of competency as well as possible multiple sanctions is particularly explosive due to the differences between the national liability systems and legal persons. The work examines the emergence, avoidance and settlement of conflicts of jurisdiction in the context of transnational association responsibility in the eu. On the basis of deficits in the existing legal situation to be demonstrated, practicable solutions to guarantee a union-wide coordinated and rule-of-law corporate sanctioning are developed.
