Book Description
During the twentieth century, a technique of intervention appears in several disciplines, under different terms. Authors of distant learned identities prescribe the same refreshing practice of the exercise of authority. In managing an asymmetrical relationship, she encourages sharing of autonomy, information and responsibilities with the subordinate. However, the way of justifying this novelty varies according to the division between public law and private law in the face of professional, so-called "private" reports of practice, the practice manuals promote it in the name of human rights; in the face of so-called "public" reports, legal theorists prescribe it in the name of clinical efficacy. What is going on? A prescriptive applied science of rules of law and a prescriptive public law of efficiency? This book proposes a theory and a sociology of Quebec's example of "voluntary measures" in public protection of youth. All this illustrates an unknown, but close, contemporary relationship between the scholarly order and the political order, but also the splendors and practical miseries of a technical novelty that we still have to master.
