Book Description
The regulation of access to genetic resources is one of the central themes of the Convention on Biological Diversity (CBD), dated 1992. This Convention gives States the right to define the modalities of access to genetic resources located on their territory in order to ensure the sharing of benefits from the exploitation of these resources. Brazil, as one of the most biodiverse countries on the planet, is very touched by this issue. However, since the entry into force of the CBD, Brazil has been unable to adopt laws and policies to control the exchange of genetic resources in a way that promotes benefit-sharing. The implementation of the Brazilian regime of "access and benefit sharing" (APA) indeed proves very complex, because full of stakes and rivalries of all kinds. This book looks at the reasons for this dysfunction from a look at the different levels of conflict. The result is a three-scale analysis (international, national, local) that aims to highlight the major issues of biodiversity regulation.
