Book Description
This Volume IV of the Collection of Constitutional Law, by Professor Allan R. Brewer-Carias, on the institutions of the democratic State of law in the Constitution of 1961, aims to study, in 1,180 pages, the configuration and consolidation of the State of right in the constitutional regime of the democratic period that began in 1958 and worked until 1999. The exhibition is part of what the author explained in the first three volumes of the work Instituciones Políticas y Constitucionales, published in six volumes by the Catholic University of TAchira and the Venezuelan Juridical Editorial between 1996 and 1998, and exhausted aNos ago. The volume is divided into nine parts, preceded by an Introduction in which the essential principles of the constitutional system are studied, the legal system and the democratic and social State of law that the Constitution of 1961 established. The first part studies the principles of the rule of law, in particular, the idea of ​​the Constitution, the limitation of power as a guarantee of freedom, the submission of the State to the law, the declaration of fundamental rights and liberties, and the judicial control of the constitutionality. The second part studies the Political Constitution, with special reference to the following bases of the constitutional system in the Constitution of 1961: the political and constitutional regime, the characteristics of the constitutional order, the problems of the democratic and social state of law regulated by the Constitution, and the crisis of the centralized state of parties developed in the same .. The third part refers to the Economic Constitution, with particular reference to the regime of property and economic freedom and its evolution. The fourth part refers to the regime of public power, with particular reference to the system of its distribution and its exercise, the configuration of public finances, the system of state functions, the principle of legality, and the subject of State security. The fifth part studies the constitutional bases of the international performance of the State, with particular reference to the territory of the State, its relations with the church and the Latin American economic integration regime and the constitutional demands and problems of the process of economic integration. The sixth and seventh parts refer to the regime of the political and constitutional structure of the State in the federal form, on the basis of the territorial distribution of power and political decentralization, with particular reference to the regime of States and Municipalities. The eighth part studies the system of government of the republic, with particular reference to the organs of the executive, legislative and judicial powers, under the principle of the separation of powers, and especially to the presidential system of government with parliamentary subjection that Regulated the Constitution of 1961.
